In consideration of being allowed to enter the premises of the Animal Park at the Conservators Center (“the Animal Park”) you are required to acknowledge, understand, accept the rules, representations, and warranties set forth below, and communicated by authorized staff member or tour guide (“staff”). Your presence and the presence of any children under your supervision at the Animal Park is a privilege. Failure to follow any of the rules set forth below may lead to being expelled from the Animal Park. The Animal Park houses and cares for exotic animals over many different lines of species. These animals are inherently dangerous. While contained within enclosures, their actions and behavior can be unpredictable, dangerous and/or possibly deadly. I assume any and all risk of injury or death for myself and for any children under my supervision while at the Animal Park.

For safety, there will be at least one experienced tour guide or staff member will remain with all tour groups. I, and any children under my supervision, must remain with the tour guide or staff member at all times and obey his/her orders. At no time will a child under my supervision be left unattended or allowed within five feet of the enclosure of any animal.

In order to walk through the Animal Park, it may be necessary to traverse walkways, trails, natural areas, and paths (collectively ‘paths”) subject to weather patterns or that are under construction. These paths may be uneven, contain loose gravel, potholes, and/or debris. I, and any children under my supervision, will watch our footing, and will use a stroller solely at our own discretion. I, and any children under my supervision, will stay away from and out of areas that are off limits.

There may be an opportunity to interact with an educational animal presented by a staff member. In these limited cases, it has been deemed lower risk to have this interaction.

Otherwise, the animals onsite are wild and may be dangerous. Unauthorized contact could lead to serious injury or death. I understand that crossing the tour barrier without explicit permission from a staff member is forbidden and further understand that there will be no contact with animals by myself or any children under my supervision.

I understand that I, as well as any children under my supervision, shall not be allowed to taunt, tease, throw objects at, or otherwise bother the animals. This includes yelling, running, and other behaviors that might upset or overstimulate the animals. Visitors engaged in these activities or any behaviors deemed harmful to the animals by a staff member may be expelled from the Animal Park.

In consideration for my admission and that of any child under my supervision, I irrevocably release, waive, discharge, and hold harmless the Animal Park, including all employees, officers, directors, trustees, volunteers, attorneys, administrators, and insurers from any and all claims, actions, causes of action, damages, whether in law or in equity, which germinate from, arise out of, or in any way relate to my visit to the Animal Park or any activities undertaken at the Animal Park. If any provision of this Release is held by a court to be invalid, void, or unenforceable, the remainder of the Release shall remain in full force and effect and shall in no way be affected, impaired, or invalidated. This Release shall be governed, where appropriate, by the laws of the State of North Carolina including all common law defenses of assumption of risk and contributory negligence.

I state that I am eighteen (18) years of age or older and have fully read this Release, which I acknowledge to be written in terms that I understand. I further stipulate I am entering into this Release freely and voluntarily of my own choice and without duress. By signing the waiver below, I acknowledge notification of the hazards and potential dangers that may result from breaking the rules of the Animal Park, and have discussed them with any children under my supervision accompanying me on this visit. In witness whereof, the releaser has executed this release at Burlington, North Carolina.
